1. Definitions

Controller – Sklep z Domami M. Miłowska, J. Palka Spółka Jawna, contact details as set out in the “Contact details” section.

Personal data – any information relating to an identified or identifiable natural person.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data.

Website – the website operated by the Controller at https://sklepzdomami.com.

User – any natural person visiting the Website or using its functions.

2. Processing of data in connection with use of the Website

In connection with the User’s use of the Website https://sklepzdomami.com, the Controller collects data to the extent necessary to present the Szmaragdowa 7 development, handle enquiries and ensure the proper operation of the site.

The Website is informational. We do not operate user accounts, a newsletter or online sales with payment via the site.

3. Purposes and legal bases of processing

We process personal data for the following purposes:

· presenting the offer and information about the Szmaragdowa 7 development;

· handling enquiries made by phone, e-mail or the visit-booking form on the Website;

· organising visits to the construction site after prior contact;

· operating social-media profiles (Facebook, X);

· ensuring the security of the Website and protecting against abuse;

· establishing, exercising or defending legal claims.

Legal bases of processing:

· Article 6(1)(b) GDPR – steps taken at the request of the data subject prior to entering into a contract;

· Article 6(1)(f) GDPR – the Controller’s legitimate interest (operating the Website, security, correspondence);

· Article 6(1)(a) GDPR – only where a separate consent is given, if introduced in the future.

4. Getting in touch and booking visits

Data provided by phone, e-mail (biuro@sklepzdomami.pl) or when booking a visit via the “Book a visit” function on the Website (first name, last name, e-mail, phone, selected time) are processed in order to reply to enquiries, reserve a time slot and arrange a meeting on the construction site. The visit may be recorded in the Controller’s Google Calendar.

The data may include: full name, phone number, e-mail address, preferred visit date and the content of the message.

Correspondence data are stored for as long as needed to handle the matter, and then for the period required by law or until claims become time-barred.

5. Social media

The Controller maintains profiles on Facebook and X (Twitter). After you go to those profiles, those services become separate controllers of data and apply their own processing rules:

Data provided in comments or private messages on those platforms are processed in order to communicate with Users and promote the development.

7. Retention period

We process data for as long as needed to fulfil the purpose, including:

· correspondence – until the matter is closed, no longer than 3 years from the last contact, unless a longer period is required by law;

· technical server logs – in accordance with the hosting provider’s policy, usually up to 30 days;

· data processed on the basis of consent – until it is withdrawn.

After the retention period, data are deleted or anonymised.

8. Your rights

You have the right to:

· access your data (Article 15 GDPR);

· rectify your data (Article 16 GDPR);

· erase your data (Article 17 GDPR);

· restrict processing (Article 18 GDPR);

· data portability (Article 20 GDPR);

· object to processing (Article 21 GDPR);

· withdraw consent at any time if processing is based on consent;

· lodge a complaint with the President of the Personal Data Protection Office (ul. Stawki 2, 00-193 Warsaw, kancelaria@uodo.gov.pl).

9. Recipients of data

Data may be disclosed to entities supporting the Controller, in particular:

· Vercel Inc. — hosting and delivery of the Website;

· e-mail and telecommunications providers;

· accounting and legal service providers — to the extent necessary to fulfil legal obligations.

Data may be disclosed to public authorities where required by law.

10. Transfers outside the EEA

Hosting of the Website may involve transferring technical data (e.g. IP address, logs) to third countries, including the USA, by Vercel Inc.

Transfers are made using mechanisms that ensure an adequate level of protection, including standard contractual clauses approved by the European Commission.

11. Security of personal data

The Controller applies technical and organisational measures appropriate to the risk, including transmission encryption (HTTPS), access control and regular software updates.

Data are collected to an extent adequate to the purpose and stored no longer than necessary.
